This contract entered into on the date of acceptance, by and between the listed Purchaser and Seller, who mutually agree to abide by the following

TERMS AND CONDITIONS. The terms and conditions specified herein constitute the entire agreement between the parties. No other agreements or promises, whether verbal or implied, are included. Purchaser agrees to buy this horse as is, with no warranty implied or offered, and may elect to have a pre-purchase examination performed by a licensed veterinarian, at his or her expense, prior to said purchase. This agreement constitutes the entire agreement between the parties. No other agreements, whether verbal, or implied, are included unless outlined herein. Purchaser agrees to buy this horse, as is, for the purchase price listed herein. The purchase price will be paid in U.S. Dollars by cashier's check, bank wire transfer or cleared check, prior to the removal of said horse from Seller's premises. Seller warrants a clear, unencumbered title on this horse that is free from any and all liens. Seller will transfer title on this horse to Purchaser, at Seller's expense, upon payment clearance, within ten days from the date of said clearance.
INSURANCE. Responsibility for insurance and risk of loss passes to the horse owner with this contract. Purchaser assumes the unavoidable risks inherent in all horse-related activities including, but not limited to accident, loss of use, theft, illness, death, loss, damage and injury to the horse, owner, owner's family and friends that may accompany owner on Seller's premises. Purchaser agrees to look solely to his/her insurance, if any, for compensation for any such loss, and further agrees to indemnify and hold harmless, the Seller, his/her family, agents or employees. WARNING: "Under Texas law (Chapter 87, Civil Practice and Remedies Code), an equine professional is not liable for an injury to, or the death of, a participant in equine activities resulting from the inherent risks of equine activities.
DEFAULT. Purchaser agrees to return said horse to Seller, at Purchaser's expense within five (5) days if in default of payment on said horse, and to pay an 18% per annum late fee on the default from the date of purchase. Payments outlined under Section 5 of Paragraph 1. Regarding TERMS AND CONDITIONS OF THIS SALE, that are past due thirty (30) days will be considered a default and Seller is entitled to an unencumbered possessory lien against Purchaser's horse(s) and an 18% per annum interest charge on all late payments. In the event it becomes necessary to refer debts arising from this contract to an attorney for collection, or if suit is instituted hereon, Purchaser agrees to pay all reasonable court costs and attorney's fees incurred by Seller, in the suit or collection.
SIGNATURE ATTESTATION AND LOCATION WHERE CONTRACT IS DEEMED TO HAVE BEEN ENTERED INTO. Purchaser's signature on this contract attests to the fact that the Purchaser has read and fully understands all of the terms and conditions outlined herein, and accepts this contract as a legal and binding instrument on behalf of Purchaser, Purchaser's heirs, successors and assigns. This contract is made and entered into, in the County of Denton, regardless of the manner or location of solicitation, and shall be interpreted, enforced and transacted under the laws of the State of Texas.
OPTIONAL PAYMENT PLAN. Seller has agreed to let Purchaser make periodic payments for said horse within six months from this date as outlined herein:

Seller's or Seller's Agent's initials here to signify that periodic payments have been agreed upon as outlined herein, following a minimum 30% down payment. Payments past due 15 days from the payment due date outlined herein, or checks that are returned for non-sufficient funds shall be considered a default as outlined herein and this contract shall be immediately turned over to an attorney for collection. The Seller will accept the return of the horse during the term of this contract for periodic payments only, if the horse is returned in the same physical and emotional shape it was in when it was purchased. In the event that the horse's soundness, disposition or physical shape has been damaged or altered in any way, then the balance of the sales price is due and payable as outlined herein.
